Privacy policy

Article 1: Glossary

For greater clarity in reading the articles below,

  • ‘Publisher’: means PREMIERS PLANS ASSOCIATION.

  • ‘Site’: is the PREMIERS PLANS ASSOCIATION Website accessible at https://www.premiersplans.org 

  • ‘User’: is any person who visits one or more pages of the Site.

Article 2: Protection of personal data

The Publisher undertakes to comply with the provisions of :

  • European Regulation (EU) no. 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data

  • Law no. 2018-493 of 20 June 2018 on the protection of personal data

  • Law no. 78-17 of 6 January 1978 on data processing, data files and individual liberties, amended by various decrees including decree no. 2019-536 of 29 May 2019,

  • Law no. 2004-575 of 21 June 2004 on confidence in the digital economy,

  • the French Post and Electronic Communications Code, Book II on electronic communications

and to take all necessary precautions to protect the security of the personal information entrusted to it.

The Publisher reserves the right to modify these Terms of Use of the Site and invites the User to consult them regularly. This Site respects and protects Users' privacy by making every action possible and proportionate so as not to infringe Users' rights. This privacy policy applies exclusively to the online activities of this Site and is valid for Users of the Site. It does not apply to information collected through channels other than this Site. The aim of the confidentiality policy is to provide maximum transparency regarding the information that the Site collects  and how it uses them.

Article 3 - Data controller

The Data Controller is ASSOCIATION PREMIERS PLANS, 9 rue Jeanne Moreau, 49100 ANGERS.

Article 4 - Legal basis for processing

The basis for processing is consent.

At the time of use or consultation, Users explicitly approve this privacy policy and consent to the processing of their personal data in accordance with the methods and purposes described below, including disclosure to third parties if necessary for the provision of a service. The provision of data and therefore consent to the collection and processing of data is optional, the User may refuse consent and may revoke consent already given at any time.

It is the User who decides to fill in the contact form located in the ‘Newsletter’ section in order to receive targeted communications after giving his/her e-mail address.

This Site processes part of the data according to the legitimate interests of the data controller for the security of the Site and that of the Publisher.

Article 5 - Categories of data processed and their uses

The categories of personal data collected via the ‘Newsletter’ section of the Site are as follows

  • first name, surname, town, postcode, country, e-mail.

The information requested is used to target the sending of newsletters.

This Site also uses log files in which information collected automatically during Users' visits is stored: (to be checked if yes or no, adjusted if necessary or deleted)

Internet Protocol (IP) address,

type of browser and parameters of the device used to connect to the Site,

name of the Internet Service Provider (ISP),

date and time of visit.

Article 6 - Recipients of the personal data collected

In addition to the owner, in certain cases, categories of staff involved in the organisation of the Site (administrative, sales, marketing, legal, system administrators) or external parties (such as third-party technical service providers, email service providers, hosting providers, IT companies, communications agencies) may have access to the data.

In any event, data will never be communicated to third parties other than for the proper operation of the Site and the service, for any reason whatsoever, except at the legitimate request of the judicial authorities and only in the cases provided for by law.

Article 7 - Retention of collected personal data

The storage periods for the data collected are variable:

  • Newsletter subscription data is kept until you tell us that you no longer wish to receive it by clicking on the link attached to the newsletter.

Article 8 - Protection of personal data collected

The Publisher undertakes to work to ensure the security and confidentiality of the data processed on its processing software. The Site is secured using the HTTPS protocol, which means that data exchanged between the Site and the User is encrypted.

The Publisher also undertakes to take all necessary precautions to protect the personal data processed by its services, and in particular to prevent such data from being distorted, damaged or communicated to unauthorised third parties.

This Site processes Users' data lawfully and correctly, taking appropriate security measures to prevent any unauthorised access, disclosure, modification or destruction of the data. Processing is carried out using IT and/or telematic tools, with organisational methods and logic that are strictly related to the purposes indicated.

Article 9 - Data storage

Orders are stored on servers in France.

Article 10 - Right of access

In accordance with current legislation, all Users have the right to access their personal data.

The Publisher will, however, take the precaution of verifying the identity of the requestor by means of a signed identity document before granting him/her access to his/her personal data. He will receive a reply within 30 days.

Article 11: Right of rectification

In accordance with current legislation, all Users have the right to rectify their personal data.

This right allows personal data that is inaccurate, incomplete, ambiguous or out of date to be rectified, completed, updated, blocked or deleted.

Users may exercise this right by sending a letter to ASSOCIATION PREMIERS PLANS, 9 rue Jeanne Moreau, 49100 ANGERS or an e-mail to dpo@premiersplans.org.

The Publisher will, however, take the precaution of verifying the identity of the requestor via a signed identity document before proceeding with the modification of his/her personal data. He will receive a reply within 30 days.

Article 12 - Right of deletion

In accordance with current legislation, all Users have the right to delete their personal data.

This right allows personal data to be deleted.
The User may exercise this right by sending a letter to ASSOCIATION PREMIERS PLANS, 9 rue Jeanne Moreau, 49100 ANGERS or an e-mail to dpo@premiersplans.org.

The Publisher will, however, take the precaution of verifying the identity of the requestor via a signed identity document before proceeding to delete his/her personal data before the end of the retention period (see article Retention of collected personal data). The Publisher will receive a reply within 30 days.

Article 13 - Right to object on legitimate grounds

The Publisher will consider any request to oppose the use of personal data in accordance with the principles set out in the previous articles.

The User may exercise this right by sending a letter to ASSOCIATION PREMIERS PLANS, 9 rue Jeanne Moreau, 49100 ANGERS or an email to dpo@premiersplans.org.

The Publisher will, however, take the precaution of verifying the identity of the requestor via a signed identity document before proceeding with this opposition. He will receive a reply within 30 days.

Article 14 - Right to limit processing

In accordance with current legislation, all users have the right to limit the processing of their personal data, i.e. to freeze the data at a specific point in time.

The User may exercise this right by sending a letter to ASSOCIATION PREMIERS PLANS, 9 rue Jeanne Moreau, 49100 ANGERS or an email to dpo@premiersplans.org.

The Publisher will, however, take the precaution of verifying the identity of the requestor by means of a signed identity document. The User will be informed of the lifting of the restriction by the Publisher. He will receive a reply within 30 days.

Article 15 - Cookies

Browsing the Site may cause cookies to be installed on the User's computer. A cookie is a small file which does not allow the User to be identified, but which records information relating to the browsing of a computer on a Site. The data obtained in this way is intended to facilitate subsequent browsing of the Site and is also used to measure the number of visitors to the Site.

The list of cookies present, their purposes and their data retention periods is available on arrival at the Site by clicking on ‘cookie settings’.

Article 16 - Cookie settings

Refusal to install a cookie may make it impossible to access certain services. The User may, however, configure his or her computer as follows to refuse the installation of cookies

  • On Brave: Click on the menu icon (symbolised by 3 horizontal lines) in the top right-hand corner of the browser. Select Settings. In the ‘protection’ section, you can block cookies.

  • In Chrome: Click on the menu icon (symbolised by three horizontal lines) in the top right-hand corner of the browser. Select Settings. Click on Show advanced settings. In the ‘Confidentiality’ section, click on preferences. In the ‘Confidentiality’ tab, you can block cookies.

  • In Firefox: at the top of the browser window, click on the Firefox button, then go to the Options tab. Click on the Privacy tab. Set the Retention Rules to: use personalised settings for history. Finally, uncheck it to deactivate cookies.

  • In Internet Explorer: Tools tab (pictogram in the shape of a cog in the top right-hand corner) / Internet options. Click on Confidentiality and choose Block all cookies. Confirm with Ok.

  • On Safari: Click on the menu icon (symbolised by a cog) at the top right of the browser. Select Settings. Click on Show advanced settings. In the ‘Confidentiality’ section, click on Content settings. In the ‘Cookies’ section, you can block cookies.

Article 17 - Social networks

The Publisher's Site uses plug-ins from the social networks Instagram, LinkedIn, Meta and YouTube (plug-in = extension which is added to your application in order to provide it with new functions. A plug-in cannot function on its own and is often created by Users).

Social plug-ins are identical to the logos on the Websites. These plugins are programmed not to create any cookies when the page is accessed, in order to protect the User's confidentiality.

If the User calls up an Internet page on the Publisher's Site containing these social plugins, a direct connection is established with the servers of this social network. The image that the User sees of the plugin and the underlying functions are then transmitted directly to the User's browser, which integrates them.

The Publisher therefore draws the User's attention to the fact that the content and volume of the data collected and transmitted directly to this network via the social plugin, as well as the duration of storage and the purpose of use, are determined exclusively by this provider.

Article 18 - Right to lodge a complaint with a supervisory authority

The Publisher aims to find an amicable solution to any disputes that may arise.

Users may therefore contact the Publisher's Data Protection Officers at dpo@premiersplans.org.

Nevertheless, each User has the right to lodge a complaint with the supervisory authority. In France, the competent supervisory authority for the protection of personal data is the Commission Nationale de l'Informatique et des Libertés (CNIL), whose Website is available at this address: https://www.cnil.fr.
